SPECIAL TOWN COUNCIL MEETING

CALL TO ORDER – Acting Mayor Arnold called the Meeting to order at 7:02 p.m.

PLEDGE OF ALLEGIANCE – Acting Mayor Arnold

INVOCATION – Councilman Bill Spruill

Council attending:  Acting Mayor Butch Arnold, Secretary Georgette Williams, Councilman Bill Spruill, Councilman Terry Witt

Council absent:  None

Staff attending:  Town Clerk Pamela Haddick, Police Chief Chuck Manuszak

Audience attending: Richard & Joyce Stockslager, Jacqueline Stokes,  Jack Fairfull, Dave & BJ Van Kavelaar, Dale Rife, Laurie Coventry, Gene & Carol McFann, Mike Marasco, TJ Tieman

ADOPTION OF AGENDA

  • Mr. Witt moved to adopt the agenda.  Ms. Williams seconded the motion.  All in favor; none opposed.

CHARTER CHANGES
Acting Mayor Arnold turned over the reading of the Charter Changes to Ms. Haddick.

  • Section 3.2 Qualifications -  Ms. Williams moved to accept changes.  Mr. Witt seconded the motion.  All in favor; none opposed.
  • Section 3.3 Term of Office -  Dale Rife commented that she could see a definite benefit with having the mayor’s term last 3 years.  Ms. Williams moved to accept the change.  Mr. Spruill seconded the motion.  All in favor; none opposed.
  • Section 4 – Council has some questions regarding the removal of the criminal background check on those wishing to run for office and freeholders being qualified to vote.
  • Section 5 – Council wants to change April back to May.  Ms. Williams moved to accept with changing from April to May.  Mr. Spruill seconded the motion.  All in favor; none opposed.
  • Section 9, 10, & 11 – Council wants to take back to the attorney
  • Section 12 – Contracts for a 1 time purchase must go to bid if over $1,000.  If under $1,000 must have unanimous approval of Council.  Mr. Witt moved to approve.  Mr. Spruill seconded the motion.  All in favor; none opposed.
  • Section 13 – OK if five (5) places can include the Website.  Ms. Williams moved to approve.  Mr. Spruill seconded the motion.  All in favor; none opposed.
  • Section 14.1 – Change April back to May.  Ms. Williams moved to accept with changing April back to May.  Mr. Witt seconded the motion.  All in favor; none opposed. 
  • Section 14.4 – Duties of Mayor adding acting on behalf of the Town without prior Council approval in event of sudden emergency.  Ms. Williams moved to approve.  Mr. Witt seconded the motion.  All in favor; none opposed.
  • Section 14.5 – Secretary – Ms. Williams moved to accept.  Mr. Spruill seconded the motion.  All in favor; none opposed.
  • Section 14.6 – Treasurer – Ms. Williams moved to accept with changing “President” to “Mayor”.  Mr. Witt seconded the motion.  All in favor; none opposed.
  • Section 14.7 – Requiring Town to have $30,000 bond on Collector of Taxes – not necessary as Town has Public Employee Bond on all employees handling money in the amount of $1,000,000 – will have Nicole check with insurance company.
  •  Section 14.8 – Auditor – Change May back to April.  Mr. Spruill moved to approve with changing May back to April.  Mr. Witt seconded the motion.  All in favor; none opposed.
  • Section 14.10 – Police – Ms. Williams moved to accept.  Mr. Spruill seconded the motion.  All in favor; none opposed.
  • Section 14.11 – Police Chief – Ms. Williams moved to accept.  Mr. Spruill seconded the motion.  All in favor; none opposed.
  • Section 15 – Needs clarification.
  • Section 16 – Ms. Williams moved to accept.  Mr. Witt seconded the motion.  All in favor; none opposed.
  • Section 17 – Mr. Witt moved to accept.  Ms. Williams seconded the motion.  All in favor; none opposed.
  • Section 18 – Have attorney look at this.  Also how relates to Section 21.
  • Section 19 – Ms. Williams moved to approve.  Mr. Witt seconded the motion.  All in favor; none opposed.
  • Section 20 – FY, Annual Statement – Remove Town Website – change 4 to 5 public places with period after places.  Ms. Williams move to accept with above changes.  Mr. Spruill seconded the motion.  All in favor; none opposed.
  • Section 21 – Have attorney look at this.  Also how relates to Section 18.
  • Section 23 – Streets and Alleys – Mr. Witt moved to accept.  Ms. Williams seconded the motion.  All in favor; none opposed.
  • Sections 24, 25 & 26 – Ms. Williams moved to accept.  Mr. Witt seconded the motion.  All in favor; none opposed.
  • Section 28 – Health – Mr. Witt moved to accept.  Mr. Spruill seconded the motion.  All in favor; none opposed.
  • Section 31 – Fines – Why reduce fine maximum from $5,000 to $1,000?
  • Section 32 – Have attorney look at this.
  • Sections 35 & 36 – Subdivision & Land Development and Annexation – Have attorney look at these.

Mr. Witt moved to adjourn the meeting.  Ms. Williams seconded the motion.  All in favor; none opposed.

The meeting was adjourned at 10:01 p.m.
